Right of Withdrawal and Returns (Emergency Ordinance No. 34/2014)

According to Emergency Ordinance No. 34/2014 regarding consumer protection in distance contracts, consumers have a period of 14 calendar days to return products purchased online, without being required to justify their decision.
Important: This right applies only to new and sealed products, which have not been opened or used.

Returns of Second-Hand Products

According to applicable law, second-hand products are NOT legally eligible for return.
However, Games Funattic exceptionally allows the return of second-hand products under the following conditions:

  • The client may request a return within 24 hours of receiving the package;

  • Return is accepted only if:

    • The product has functional defects that were not mentioned in the description;

    • The product does not meet the customer's expectations (e.g., aesthetic condition);

  • The product must be returned in the same condition in which it was delivered, along with all accessories and any bonuses included;

  • Return shipping costs are covered by the customer, except when the product is faulty.

Return Exceptions (OUG 34/2014, art. 16)

Returns are not accepted in the following cases:

  • Unsealed video games;

  • Products containing digital codes (digital games, accounts);

  • Personalized products or items from limited promotional campaigns.

Return Conditions

To be eligible for return, the product must:

  • Be in its original condition;

  • Include original packaging, accessories, manuals, and warranty certificate (if applicable);

  • Show no signs of damage or excessive wear caused by the customer.

Return Procedure

To request a return:

  • The customer must send an email to contact@gamesfunattic.ro within:

    • 14 days (for new products);

    • 24 hours (for second-hand products);

  • The email must include: name, order number, returned product, and reason for return;

  • Once our team confirms the request, the product must be sent via courier to the communicated address.

Refund of Paid Amount

  • The refund will be processed within 14 calendar days from the receipt of the returned product;

  • The refund will be made to the account provided in the return form;

  • Shipping costs are NOT refundable, except in cases where the delivered product was incorrect or defective.

Discounts and Commercial Benefits

If the order included commercial discounts, vouchers, or free shipping, and the customer partially returns the order, the value of the benefits will be deducted from the refunded amount, according to OUG 34/2014.

Depreciation of Returned Product Value (Directive 2011/83/EU, paragraph 47)

If the product was used improperly and shows signs of wear, an amount between 5% and 50% of the product’s original value may be withheld, proportional to the observed deterioration.
